The Ontario Land Tribunal has granted approval to sever 40 Church Street in Ancaster into six separate lots to permit the development of six street townhouses.
The application had previously been denied by Hamilton’s Committee of Adjustment, with concerns raised about neighbourhood character and intensification. However, on appeal, the Tribunal approved the severances, confirming the proposal met provincial planning policies and aligned with the broader direction for increased housing supply within existing communities.
During the original Committee hearing, residents cited concerns related to tree loss, traffic, and privacy. The OLT hearing itself was brief, with the Tribunal focusing primarily on conformity with provincial and municipal planning frameworks.
The decision reinforces a clear theme we’re continuing to see locally: when a proposal satisfies Provincial Planning Statement requirements and Official Plan policies, approval through the appeal process is increasingly likely — even where there is local opposition.
